It is becoming increasingly common for buyer’s solicitors to request a seller supplies some or all of the following:
- A boiler service where one has not been completed within the last 12 months;
- Routine gas safety certificate in respect of any boilers, fires or other gas installations;
- Electrical safety certificate / inspection.
Unless the property is rented to tenants, you are not under a legal obligation to have routine gas or electrical checks. Although you may choose to do so. Boiler servicing is also at an owner’s discretion.
You may wish to accommodate the buyer’s request at your own cost but this is not a legal obligation. You are entitled to say no and invite the buyer to arrange such inspections and certificates themselves, at their own cost.
Gas and Electrical Installations
Whilst noting the above in respect of routine checks and services, if you have undertaken the installation of any gas appliance such as a fire or boiler during your ownership, the buyer will expect to see the gas safety installation certificate.
If you have undertaken electrical work during your ownership, the buyer will also expect to see the installation certificates.
Where certificates for works are not available, provided the works were undertaken more than 12 months ago, it is usually possible to obtain defective title indemnity insurance at a relatively low costs of between £15 – £50 depending on the sale price. This is a one-off payment, payable out of the sale proceeds and we can arrange the insurance for you. This is often a quicker and more cost effective solution than obtaining duplicate certificates.
